Release of the book "Unfair Competition - Acts of Confusion" written by the senior partner Alberto Camelier.
Known as "acts of confusion" the acts committed by agents that imitates or reproduce the distinctive signs which it does not own, in open violation of the duty of commercial and industrial loyalty. The aim of the acts of confuision is to obtain an unlawful advantage for themselves, using the ruse to confuse consumers about the origin of businesses, products and services.
Fruit of the masters thesis of the author, Unfair Competition: acts of Confusion discusses the historical evolution of the institution of unfair competition in Brazil and abroad, analyzing its development in doctrine and in national and international internalized, derived from treaties and conventions, especially Paris Convention for the Protection of Industrial Property, known as the Paris Convention.
Are the object of analysis, the main "acts confusórios" known and observed in doctrine, among them the imitation of Trade Dress or set-image; imitation packaging, brand indeed; expression advertising, business name, title of establishment; insignia and domain name, which must be addressed through the repression of unfair competition because contrary to the constitutional principles of free enterprise and free competition and it appears as tort and criminal.
